Electric Vehicle XPS Terms and Conditions
These terms and conditions form part of the EV XPS Agreement and give you consent to use the EV cable channel for the purpose of running electric vehicle charging cable from a property to the carriageway.
TERMS AND CONDITIONS- Gul-e Cross Pavement Solutions
- A preliminary site inspection will be undertaken to determine the type of pavement construction, width of pavement, and the safety of the intended parking area. The presence of double yellow lines or adjacent crossings or junctions are considered also. We consider the presence of other assets in the area (for example, piping, telecoms cabling), their condition and the impact the installation of a cable channel may have on their condition or future access. The positioning of the cross-pavement solution may need to avoid surface utility access covers or tree roots. Application of cross-pavement solution is subject to refusal due to site conditions.
- Ownership of the Gul-e Device shall remain with Thurrock Council indefinitely.
- The Resident is responsible for securing planning permission from their Local Planning Authority for the installation of a home charger at their property.
- The Resident agrees to park their car at least 2.5 metres away from metal-cased electrical equipment such as lampposts and electrical cabinets when using the charging channel.
- The Resident will be responsible for light maintenance of the Gul-e Device (including but not limited to flushing the channel out with a brush and hose if needed) and reporting any issues with the Gul-e Device to Thurrock Council. Lack of maintenance may affect performance and will not be viewed as a product defect.
- Thurrock Council shall not be liable for any damages or injury to any Party as a result of the Resident’s use of the Gul-e Device.
- The Resident shall not sell, transfer, use as collateral or move the Gul-e Device at any time, or deal with the Gul-e Device in any way.
- All electricity costs incurred by the Resident in using the Gul-e Device to charge the Resident’s electric vehicle shall be the responsibility of the Resident.
- The Resident agrees to inform the Thurrock Council if they move property.
- This Agreement is personal to the Resident, who may not assign or otherwise transfer their rights under this Agreement to any third party.
- The Resident acknowledges and agrees that nothing in this Agreement grants the Resident a right to park directly outside the Resident’s Property, and that, being a public highway, the parking space outside the Resident’s property may be occupied at any time by vehicles other than the Resident’s own. It is prohibited to add any cones or signs implying the reservation for parking or charging EVs.
- It is the Resident’s responsibility to ensure that their electric vehicle charging equipment, and their use of the Gul-e Device does not generate any electrical hazard.
- Installations of EV charging equipment must comply with BS-7671. This includes considering eventual proximity of charging electric vehicles with separately earthed equipment, such as another charging vehicle or lamp post.
- The Gul-e Device must only be used to charge an electric vehicle with charging equipment that has been approved. This must be an approved Electric Vehicle Supply Equipment (EVSE) charging cable in conjunction with a dedicated home EV charging point (installed by a qualified, registered electrician).
- Domestic extension cables, ‘granny cables’, and three-pin plugs must not be used for EV charging.
- It is the Resident’s responsibility to check that their EV charging cable is safe to use prior to each charging event – this should include checking the charging cable along its entire length for any splits or exposed wires.
- It is the Resident’s responsibility to ensure that their use of the Gul-e Device does not cause any hazard to pedestrians or other users of the public highway.
- The Resident must not leave any trip hazards e.g. loops or twists of cable protruding above the Gul-e Device or elsewhere on the highway.
- The Resident must trail the cable for no more than 1.5 metres on the carriageway (alongside the kerb edge) to reach the vehicle’s charging socket.
- The Resident must not trail the EV charging cable on top of their vehicle when using the charging channel.
- The EV charging cable must not be stored in the Gul-e Device at any time other than when charging an EV. The cable should be removed from the Gul-e Device and stored off the public highway as soon as possible after charging has completed.
- Installation of the Gul-e Device does not alter or remove the Resident’s obligation to abide by any pre-existing parking restrictions on their street.
- The Resident understands that the presence of the Gul-e Device does not mean that Thurrock Council will not change or alter the parking restrictions on their street at some future date.
- The Resident must not mount the kerb to park their car when using the Gul-E Device.
- It is the Resident’s responsibility to keep the Gul-e Device in good working order.
- The Gul-e Device should be cleaned and cleared of debris on a regular basis to avoid build-up of leaves, silt or other matter which may prevent its proper use or cause damage to the EV charging cable.
- The Resident should check the Gul-e Device regularly for any signs of wear, rust or corrosion, and should ensure that any defects are repaired promptly through informing Thurrock Council.
- The Resident hereby confirms that the Resident holds all necessary rights to permit the installation and operation of the Gul-e Device at the Resident’s Property.
- The Resident shall indemnify Thurrock Council for any losses Thurrock Council incurs resulting from the Resident’s breach of this Agreement, failure to operate the device in accordance with the Terms and Conditions or negligence.
- In the event that the Resident is in breach of any of the terms of this Agreement, Thurrock Council may terminate this Agreement and remove the Gul-e Device from the Resident’s Property with immediate effect and the Resident must agree to repay back the cost of installation of £1000.
- This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
- Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
